Premium Processing Option Now Fully Available for EB1-C and EB2-NIW Petitions

Beginning January 30, 2023, USCIS will adjudicate EB1-C, Multinational Executives and Managers, and EB2-NIW, professionals with an advanced degree – national interest waiver of the labor certification application requirement, petitions by Premium Processing. This option will exist for both pending and new EB1-C and EB2-NIW petitions. The $2,500 Premium Processing filing fee buys either an approval or a Request for Evidence within 45 days.

The USCIS processing time website indicates that under normal processing, the Nebraska Service Center is completing 80% of the EB1-C petitions within 12.5 months, whereas the Texas Service Center’s processing time is 13.5 months. USCIS reports that both the Nebraska and Texas Service Centers are taking ten months to process 80% of EB2 petitions; a separate processing time for EB2-NIW petitions is not posted.

The “80% of cases completed” statistic allows for a substantial variation in how quickly or slowly a particular petition could be processed. For example, some EB1-C petitions are being adjudicated in just several months.
