USCIS Announces Expansion of Premium Processing for Certain Previously Filed EB-1 and EB-2 I-140 Petitions

Effective June 1, 2022, and July 1, 2022

On May 24, 2022, the United States Citizenship and Immigration Services (USCIS) announced that it will implement an expansion of Premium Processing for certain pending EB-1 and EB-2 I-140 petitions.

This expansion applies only to previously filed EB-1C Multinational Executive/Manager I-140 petitions and EB-2/National Interest Waiver (NIW) I-140 petitions. This expansion does NOT apply to new EB-1C and EB-2/NIW I-140 petitions.

Two-Phase Implementation of Expanded Premium Processing

Effective DateUSCIS Will Accept Requests for Premium Processing for the Following
June 1, 2022EB-1C Multinational Executive/Manager I-140 petitions with receipt/priority dates on or before January 1, 2021.
July 1, 2022• EB-1C Multinational Executive/Manager I-140 petitions with receipt/priority dates on or before March 1, 2021.
• EB-2/NIW I-140 petitions with receipt/priority dates on or before June 1, 2021.

USCIS will reject Premium Processing requests for ineligible EB-1C and EB-2/NIW I-140 petitions. USCIS will also continue to reject premium processing requests for new EB-1C and EB-2/NIW petitions.
